1. This Clause does not apply to a consumer as defined under local consumer law.
2. Unless otherwise specified in the Quotation/Letter of Offer, Rhima’s liability for Goods manufactured by it is limited to making good any defects by repairing the same or at Rhima’s option by replacement, within a period not exceeding twelve calendar months after the Goods have been delivered provided that:
2.1 the defects have arisen solely from faulty materials or workmanship;
2.2 the Goods have not received maltreatment, inattention or interference;
2.3 any repairs, alterations or modifications are carried out by Rhima or an authorized Rhima repairer;
2.4 accessories of any kind used by the Buyer are manufactured by, or approved by Rhima;
2.5 the seals of any kind of the Goods remain unbroken: and
2.6 the defective parts are promptly returned free of charge to Rhima.
3 If the Goods are not manufactured by Rhima any guarantee or warranty of the manufactured thereof shall be accepted by the Buyer and is the only guarantee or warranty given to the Buyer in respect of the Goods.
4 Rhima shall not be liable for, and the Buyer releases Rhima from any claims in respect of faulty or defective design of any goods supplied unless such design has been wholly prepared by Rhima and the responsibility for any claims has been specifically accepted by Rhima in writing and in any event Rhima’s liability hereunder shall be strictly limited to the replacement of defective parts in accordance with sub-clause 12.2 of this clause.
5 Unless the Buyer is a customer as defined under local consumer law except as provided herein, all express and implied warranties, guarantees and conditions under statute or general law as to merchantability, description, quality, suitability or fitness of the Goods for any purpose or as to design, assembly, installation, materials or workmanship or otherwise, are hereby expressly excluded and Rhima shall not be liable for physical or financial injury, loss or damage or for consequential loss or damage of any kind arising out of any act, omission, negligence or any other cause by Rhima, its employees, agents, contractors or servants or in any way whatsoever or howsoever arising.
6 The product warranty specifically excludes faults caused by any factors other than defects in materials or workmanship. These include, but are not limited to the following:
6.1 Repairs or adjustments by unauthorised persons including non-Rhima authorised service providers and under no circumstances will Rhima be held responsible to reimburse a third-party or the owner for un-authorised repairs carried out on this product;
6.2 Rectification of issues caused by incorrect installation, incorrect water supply pressures or temperatures, incorrect electrical supply, blocked building drains, physical damage, the use of non-suitable detergents/chemicals, electrical supply surges, flood, or other acts of God;
6.3 Adjustments to wash or rinse temperatures, detergent concentration, or rinse additive dosage;
6.4 Rectification of issues due to foreign objects in drain pumps, failure of water inlet valves, issues caused by poor water quality including high levels of scale and/or other impurities, failure of heating elements due to the use of chlorinated detergents, or failures deemed to be due to fair wear and tear;
6.5 Damage to any component including accidental damage, damage incurred during transportation and/or handling by third-parties or damage caused by exposure to conditions or environment outside of those specified by the manufacturer, damage caused by water ingress into any part of machine not designed to be subjected to water or moisture, including ingress caused by hosing machine down, operating in a poorly ventilated environment, or at temperatures outside of those specified by the manufacturer;
6.6 Issues caused by incorrect operation, or using the product for purposes for which it was not designed.
7 Product warranty is subject to certain liabilities and exclusions which include, but are not limited to the following:
7.1 The provided warranty is valid for the original purchaser only and not transferable to subsequent owners;
7.2 Warranty service is only performed during normal business hours (Mon-Fri 08:30-17:00 hrs) excluding public holidays. If Warranty service is requested by the purchaser outside of normal business hours, additional costs will be applicable and will be advised at time of booking service;
7.3 Warranty does not include travel time to customer sites if located more than 75kms outside of capital cities. Travel time will be quoted depending on customer location. Rhima may, at its discretion, choose not to charge travel time if an authorised service agent is located within 75km of the customer’s premises;
7.4 Rhima will use best endeavours to have spare parts available throughout the commercial life of the product, however Rhima will not be held liable for any costs, loss of use, reduced production, or other such business impacts due to delays or inability to supply a required part.
